These Terms and Conditions (“Terms”) apply to all orders placed with KmvT Design (“We”, “Us”, “Our”) by any customer (“You”, “Your”) via:

By placing an order, You agree to be bound by these Terms. 

KEY CONSUMER INFORMATION (SUMMARY)

Before placing your order, please note:

• We sell and deliver within the United Kingdom only.
• Most of our products are made to order and personalised.
• Personalised or bespoke products are exempt from the 14-day cancellation right under UK law.
• Non-personalised products may be returned within 14 days if unused.
• You are responsible for selecting the correct size and reviewing your artwork before placing an order.
• Minor colour and positioning variations do not constitute faults.
• Faults must be reported within 7 days of delivery with photographic evidence.
• Our primary remedy for confirmed faults is replacement.

By placing an order, you confirm that you have read, understood and accepted this information.

KmvT Design is a sole trader business operated by Madalina Sofan.

We are not currently VAT registered. All prices displayed on our website are in GBP (£) and no VAT is charged.

We sell and deliver within the United Kingdom only.


2. CONTRACT FORMATION

2.1 By placing an order through our website and clicking the confirmation button at checkout, you are making an offer to purchase the selected Products and confirming that you have read and accepted these Terms and Conditions.

2.2 After submitting your order, you will receive an automated acknowledgement email. This email confirms receipt of your order but does not constitute acceptance.

2.3 A legally binding contract between you and us is formed only when we send you an Acceptance Email confirming that your order has been accepted and is being processed or dispatched.

2.4 We reserve the right to refuse or cancel any order prior to sending the Acceptance Email.

2.5 All contracts are concluded in English.


3. PRODUCT DESCRIPTION

We take reasonable care to ensure that:

  • Products are described accurately

  • Images reflect the item as closely as possible

However:

  • Colours may vary slightly due to screen settings

  • Print and embroidery placement may vary slightly

  • Fabric texture and shade may vary between batches

Such minor variations do not constitute defects.


4. PERSONALISED / BESPOKE PRODUCTS

Most Products are made to order and customised to Your specifications.

Under Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

The 14-day cancellation right does NOT apply to goods made to the consumer’s specifications or clearly personalised.

Therefore:

Personalised or custom-made products are exempt from the 14-day cancellation right and cannot be cancelled, returned, or exchanged unless faulty.

Production may begin shortly after order confirmation. Once production has commenced, changes or cancellations are not possible.


5. CUSTOMER RESPONSIBILITIES

You are responsible for:

  • Selecting the correct size

  • Checking spelling, wording and design

  • Uploading artwork in suitable quality

  • Providing accurate delivery details

We do not offer refunds or exchanges for:

  • Incorrect size ordered

  • Spelling errors approved at checkout

  • Change of mind

  • Dissatisfaction with design choice

  • Poor quality artwork supplied by You

Size issues are not faults where the garment matches the size ordered.


6. ARTWORK & INTELLECTUAL PROPERTY

By submitting artwork, You confirm that:

  • You own the rights or have permission to use it

  • It does not infringe any third-party rights

We reserve the right to refuse unlawful or inappropriate content.

We may adjust artwork slightly to fit production requirements.


7. DELIVERY

We deliver within the United Kingdom only.

Delivery times stated on the website are estimates and are not guaranteed unless expressly confirmed as guaranteed.

Delivery is deemed complete and risk in the Products passes to you when:

  • The Products are delivered to the address provided by you at checkout; or

  • The Products are delivered in accordance with your delivery instructions (including to a neighbour or designated safe place); or

  • The courier confirms successful delivery via tracking confirmation.

It is your responsibility to ensure that:

  • The delivery address provided is accurate and complete;

  • Someone is available to accept delivery where required.

We are not responsible for delays caused by:

  • Incorrect or incomplete address details;

  • Failure to accept delivery;

  • Courier delays outside our reasonable control.

If delivery fails due to incorrect address details or non-acceptance, we reserve the right to charge for redelivery.

Title to the Products remains with us until full payment has been received.

 


8. CANCELLATION RIGHTS

8.1 Personalised / Bespoke Products

Under Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the 14-day cancellation right does NOT apply to goods that are made to the consumer’s specifications or clearly personalised.

As the majority of our products are made to order and personalised to your specification:

You do not have the right to cancel, return or exchange personalised or custom-made products unless they are faulty.

Production may begin shortly after order confirmation. Once production has started, cancellation is not possible.


8.2 NON-PERSONALISED PRODUCTS (BLANK ITEMS)

If You purchase a non-personalised item as a consumer, You have the right to cancel within 14 days of delivery.

Conditions:

  • You must notify Us within 14 days

  • Items must be unused and in original condition

  • Return postage is Your responsibility

  • Refunds will be issued within 14 days of receiving the returned goods

We may reduce refunds where goods show use beyond inspection.


9. FAULTY PRODUCTS

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

Products supplied must be:

  • Of satisfactory quality

  • Fit for purpose

  • As described


9.1 Reporting a Fault

If you believe your item is faulty, you must:

  • We ask that you contact us as soon as possible after discovering the issue and within 30 days of delivery where possible.

  • Provide your order number;

  • Provide clear photographic evidence of the issue;

  • Confirm whether the item has been washed or worn.

Items must not be returned without our written confirmation.

Failure to notify us within a reasonable time may affect your entitlement to a remedy.


9.2 Our Remedy

If a genuine manufacturing fault is confirmed, we will:

  • Offer a replacement (our primary remedy); or

  • Offer a refund if replacement is not possible.

We will reimburse reasonable return postage costs for confirmed faulty items only.


9.3 Inspection

We reserve the right to inspect returned items before issuing a replacement or refund.

If the item is found not to be faulty, it may be returned to you and redelivery costs may apply.


10. WHAT IS NOT A FAULT

The following are not considered faults:

  • Minor colour differences

  • Slight alignment or embroidery variation

  • Natural fabric texture differences

  • Wear and tear

  • Damage caused by incorrect washing

  • Damage caused after delivery

  • Incorrect size ordered

  • Subjective dissatisfaction



11. CUSTOMER-SUPPLIED GARMENTS

Where You provide Your own garments for printing or embroidery:

  • Items are supplied at Your own risk

  • We are not responsible for garment quality or fabric suitability

  • If a production error occurs, liability is limited to the cost of the printing/embroidery service only

  • We are not liable for the value of the garment itself


12. PRICE & PAYMENT

All prices displayed on our website are in GBP (£).

We are not currently VAT registered. No VAT is charged.

Delivery charges (where applicable) are shown separately at checkout before you complete your purchase.

The total price, including delivery charges, will be displayed before you confirm your order.

Payment must be made in full at the time of placing your order. We will not begin production or dispatch until full payment has been received.

We reserve the right to correct obvious pricing errors. If a pricing error is identified after you have placed an order, we will contact you and offer the option to proceed at the correct price or cancel the order with a full refund.

Taking payment does not constitute acceptance of your order. A contract is formed only when we send an Acceptance Email in accordance with Section 2.


13. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence;

  • Fraud or fraudulent misrepresentation;

  • Any matter for which liability cannot be excluded or limited under UK law.

Nothing in these Terms affects your statutory rights as a consumer.

Where you are purchasing as a business customer:

  • Our total liability arising under or in connection with the contract shall not exceed the total amount paid for the Products.

  • We shall not be liable for indirect or consequential losses, including loss of profit, business or revenue.

We shall not be liable for any loss arising from:

  • Customer misuse of the Product;

  • Failure to follow care instructions;

  • Incorrect size selection;

  • Damage occurring after delivery.


14. EVENTS OUTSIDE OUR CONTROL

We are not liable for delays caused by events beyond our reasonable control, including supply chain disruption or courier delays.

If delay exceeds 30 days, You may cancel and receive a refund for undelivered items.


15. PAYMENT DISPUTES & FRAUD PREVENTION

If you believe there is an issue with your order, you agree to contact us directly at info@kmvt.co.uk 

before initiating a payment dispute or chargeback with your card provider or payment processor.

We are committed to resolving genuine concerns quickly and fairly.

If a payment dispute or chargeback is initiated, we reserve the right to provide the payment provider with:

  • Order confirmation details;

  • Proof of customer agreement to these Terms;

  • Artwork submissions and order specifications;

  • Delivery confirmation and tracking information;

  • Copies of communication between us and you.

Where a dispute is found to be unfounded or fraudulent, we reserve the right to suspend future orders.

Nothing in this clause limits your statutory rights as a consumer.


16. GOVERNING LAW

These Terms are governed by the laws of England and Wales.

Consumers may bring claims in UK courts.
Business customers agree to exclusive jurisdiction of the courts of England and Wales.
